Juridical department

The aim of the Juridical Department is to ensure compliance with the law the activities of the Enterprise and the legal protection of its rights and interests.

The tasks of the Department are the formation and implementation of the legal policy of SUE “Dipservice”, the legal protection of the rights and interests of the enterprise, ensuring the compliance of the local regulatory acts of SUE “Dipservice” with the current legislation of the Republic of Tajikistan, drafting opinions, clarifying legal issues arising in the activities of SUE “Dipservice”.

The main functions of the Juridical Department:

  • A control of compliance in the structural subdivisions of SUE “Dipservice” with the current legislation of the Republic of Tajikistan and other local normative acts of SUE “Dipservice”.
  • A methodical guidance of legal work at SUE “Dipservice”, explanation of the current legislation and the procedure for its application, rendering legal assistance to structural units in the claim work, preparation and transfer of necessary materials to judicial and other bodies.
  • Representation of SUE “Dipservice” in court, as well as in state and public organizations when considering legal issues.
  • Keeping of claim-action work;
  • Implementation of the reception of citizens in accordance with the procedure established by SUE “Dipservice”.
  • Examination and resolution of applications, appeals, complaints of individuals and legal entities received by SUE  “Dipservice” and preparation of draft answers and conclusions on them.
  • Juridical analysis and juridical assessment of information contained in appeals of individuals and legal entities received by SUE  “Dipservice”.
  • Control over compliance with the requirements of RT legislation draft orders, local regulatory legal acts and other legal acts prepared by SUE “Dipservice”, as well as participation in the necessary cases in the preparation of these documents.
  • Adoption of measures to change or abolish local regulations issued with violation of the current legislation of the Republic of Tajikistan.
  • Informing employees of State Unitary Enterprise  “Dipservice” about the current legislation, as well as conducting work on studying by officials of SUE  “Dipservice” regulatory by legal acts related to their activities.
  • Participation in the preparation, approval, and conclusion of collective agreements, economic contracts, in their legal expertise, the development, and implementation of measures to strengthen labor discipline, the regulation of social and labor relations of SUE “Dipservice”.
  • Analysis and generalization of the results of consideration of claims, court cases, as well as the practice of concluding and executing business contracts, developing proposals to improve control over compliance with the contractual discipline on the supply of products, elimination of identified shortcomings and improving the production and economic and financial activities of SUE “Dipservice”.
  • Participation in the work on registration of applications and other documents, as well as their transfer to state bodies for obtaining licenses, permits and other permits necessary for the activities of SUE “Dipservice”.
  • Participation in the development of documents related to the issues of ensuring the security of the property of SUE “Dipservice” (contracts on liability, instructions establishing the procedure for the receipt and acceptance of material values by SUE “Dipservice”).
  • Control of the fulfillment of the tasks of the regulatory documents of the Ministry of Foreign Affairs of the Republic of Tajikistan and the management of SUE “Dipservice”, which provides the activities of the Juridical Department, including monitoring the terms of their execution.
  • Participation in the certification of employees of the Juridical Department and other units of SUE “Dipservice” within the framework of the attestation commission, the analysis of the data obtained and participation with the heads of other units in the process of placement of personnel based on the results of personnel certification, as well as the constant monitoring of the implementation of the decisions of the certification committee and the correctness of the arrangement Workers and the use of their labor.
